You about to get smarter. Okay. How do you make sure that someone doesn’t steal your name as you rise to fame? You can protect yourself by getting a service mark, which is similar to a trademark.

A trademark is a name used for goods. Okay. Like Jello. This service mark is a name used for services like Jims plumbing. In the United States. You actually get rights to the mark like this when you actually use that name, right? But to be protected by the government, you must use your name in interstate commerce, meaning commerce between two states.

Right. You’re putting your music out, among other things, on the Internet is the easiest way to do that. Right. But it used to be different and more than one. I mean, because really, if you send an email, blast all your fans in more than one state and they know your name, right, and it counts like that. But in addition to using your name across a business, you also need the public to think of you when they hear the name.

But if they hear your name and they think of you, they think of your music, they think of merchandise or other things that have to do with you, and you can actually have that because your name has so much to do with that.

That’s when your name actually becomes a trademark. Okay? So when people start to know you, it becomes a trademark. All right. So would you have a well-known trademark? You would stop people from using names that are different from yours but are close enough to cause confusion? Okay, quick, quick piece of history. Don’t know if you’ve heard of it. Have you ever heard of it from calling its star a Dallas cheerleader? Interesting, right? Why? Because trademark. Right. So remember, your rights come from using the name, not from registry. You pretty much build the name. And that’s how it becomes It is there is one exception to the rule. And one exception is that you must actually use the name.

It’s called an intent to use registration means that putting a public notice in the U.S. Patent Trademark Office tells the word you claim a certain name.
